Court stays order on prelim tests
Patna: A high court division bench of Justice Navin Sinha and Justice Shailesh Kumar Sinha on Friday stayed the order of the single bench that held the provision of quota in preliminary test as unconstitutional.
The division bench passed the interim order on an appeal filed by Bihar Public Service Commission challenging the single bench order on the ground that it (order) would frustrate the very purpose of giving quota in jobs to people belonging to the OBC and SC/ST categories. The court, which admitted the commission's petition, said the order would be implemented subject to the final outcome of the appeal. People belonging to reserved categories would continue to avail the quota benefit even in the preliminary test of any exam conducted by the state government. The single bench order, passed on August 6, had deprived these sections of availing quota benefit.
