Moot court crown on Bhopal

National Law Institute University (NLIU), Bhopal, clinched the final of Commonwealth Moot Court competition at Chanakya National Law University (CNLU) on Sunday.

The winning team will compete in the Glasgow round of the competition scheduled to be held in Scotland in January 2015.

In the final, the Bhopal law institute defeated National Law School of India University (NLSIU), Bangalore.

The topic in the final moot court competition — held under the auspices of the Commonwealth Legal Education Association (CLEA) — was “medical negligence”.

The participants had been given a case pertaining to the death of a female patient because of steroids overdose. The patient’s husband had filed a case demanding compensation for the death of his wife.

The NLIU team comprising three students — Praharsh Johorey, Aparna Raturi and Nayan Jain — arguing for the doctor pleaded that their client had given extra dose of steroids to the patient as it was required to save her life.

The three law students submitted various facts and rulings from the Supreme Court and even from foreign courts establishing the fact that extra dose of steroids can be given to patient depending upon the situation.

The defence lawyers, from the NLSIU, Bangalore, arguing for the patient, stated that this amounts to standard case of breach of medical negligence. The NLSIU team — comprising Siddharth Bajpayee, Aman Saxena and Nayomi — argued that if a doctor administers medicines beyond proven prescribed limit it amounts to medical negligence.

The five-member bench, who judged the two teams, comprised Patna High Court judges Justice Navaniti Prasad, Justice Ramesh Kumar Datta, Justice Ajay Kumar Tripathi, and two practising advocates at the Supreme Court, George Giri and Sudeep Vijayan. The bench, after hearing the arguments from both the sides, gave the verdict in favour of NLIU.

The two-day moot court competition in which 32 teams from premier national law universities participated concluded with the valedictory address of the university chancellor and Patna High Court Chief Justice Rekha M. Doshit.

During her address, Justice Doshit said: “Such types of events and competitions encourage students to deliver their best.” She also called upon the students to adhere to the ethics of advocacy that comprises basic values like hard work and high degree of professionalism.

Apart from the NLIU-Bhopal winning the best team award and NLSIU Bangalore coming second, Aparna Raturi of NLIU received the best advocate and the best lady advocate award.

S.P. Singh, the registrar of CNLU, gave away the certificates to the participating teams and proposed the vote of thanks.
