High court cancels cop bail

Meghalaya High Court has cancelled the bail application of Nurul Islam, the police officer accused of rape, the same day he was remanded to judicial custody.

Shillong, Sept. 11: Meghalaya High Court has cancelled the bail application of Nurul Islam, the police officer accused of rape, the same day he was remanded to judicial custody.

Judge of Meghalaya High Court, Justice T.N.K. Singh cancelled the bail today, which had been granted to Islam by a lower court. The high court has reserved its order though a final hearing on a criminal review petition related to this matter was held on August 31.

Islam was granted bail earlier by the court of special judge (Protection of Children from Sexual Offences), B. Mawrie.

The high court said, "The order (granting of bail) was passed by learned special judge (POCSO) by non-application of mind and also ignoring the relevant material indicating prima facie involvement of the accused (Islam). The impugned orders (dated June 24, 2015 and July 8, 2015) are illegal and perverse."

Setting aside Islam's bail orders, the high court said the accused police officer be taken to judicial custody forthwith and the bail bond and surety bonds be cancelled.

While directing the lower court to complete the trial of the case expeditiously, the high court made it clear the trial court may consider the bail application of the accused (Islam) if necessary, but according to laws and principles laid down by the apex court regarding granting of bail.

Later in the evening, Islam was produced before a court of district and sessions judge here, which remanded him to judicial custody till September 21.

Islam, who was the sub-inspector at Ampati police station in South West Garo Hills, was allegedly accused of raping two girls at Ampati in March 2013.
