In spite of numerous applications, as well as personal visits to the income-tax authorities, my tax refund of Rs 3,392 for the assessment year 1998-99 has not been made till date. Do I have any remedy for this?

Response from tax authorities

Garib Chand Sharma’s refund for the assessment year 1998-99 has already been issued in favour of the assessee vide refund voucher no. B/21 267324 book no. A 212754 dated June 7, 2001.

Prabir Basu of Consumers Unity and Guidance Forum advises:

It appears from the reply of the IT department that the refund amount was duly issued on June 7, 2001, but the office has not stated when the voucher was posted to the complainant. It would be wise to take up the matter with the department concerned if at all the said voucher has not been received in the meantime.

 

I had purchased five trees of Sanghi Plantation Limited, Hyderabad, for Rs 5,000. On December 29, 2000, the company asked for the purchased units along with 10 per cent interest from the date of investment to the date of maturity. On my submission of the units, they sent me a draft for Rs 5,000 (on February 28, 2003) and has been quiet on the interest claim. Do I have any relief before the Consumer Fora?

Failure to comply with contractual obligation amounts to deficiency in service and as such the complainant can initiate a proceeding before the Consumer Fora within whose jurisdiction the company has its registered office, asking for interest along with compensation for harassment.
