Sapphire murder case reaches SC

Ranchi businessman Manbahal Mahto, disillusioned with the tardy pace of trial into his son and Sapphire International School student Binay Mahto's murder last year, moved the Supreme Court on Friday, seeking "proper investigation" in the case.

New Delhi: Ranchi businessman Manbahal Mahto, disillusioned with the tardy pace of trial into his son and Sapphire International School student Binay Mahto's murder last year, moved the Supreme Court on Friday, seeking "proper investigation" in the case.

Mahto, who has been demanding a CBI probe for more than a year now, said the apex court's proactive role in Gurgaon's Ryan International School case had emboldened him to seek intervention in his son's murder.

Mahto, who was present in the court with wife Kashila Devi, said they were in Delhi to seek Supreme Court's intervention for proper investigations. "The apex court is playing a proactive role in the Ryan murder case. I am hoping it will not disappoint us," he said.

Class VII student Binay, then only 12 years old, was bludgeoned to death with knuckledusters allegedly by the 16-year-old son of Sapphire Hindi teacher Nazia Hussain on the Hardag campus, near the state capital, on February 5, 2016.

Nazia, her husband Arif Ali Ansari and their 12-year-old daughter tampered with evidence to hush up the killing. The family of four is currently out on bail while the trial court, which recently finished examining prosecution witnesses, hasn't convicted anyone yet.

Mahto's petition, filed through advocate Kunal Cheema, was listed as item 80 in the Supreme Court on Friday. It was heard in a jam-packed Court 10 around 1pm.

Advocate Cheema, who confirmed the development, expressed his limitations in sharing the exact order.

"The apex court heard the matter, but didn't issue any specific directive while observing that it would be appropriate to pursue the matter in a trial court and high court. The top court also observed that lower courts had the power to direct a reinvestigation. I can talk about the (apex court) order verbatim only when a certified copy reaches me," Cheema said.

Seven-year-old Pradyuman Thakur, a Class II student of Ryan International School, was found dead with his throat slit in a toilet on the campus on September 8. The CBI is currently probing the case. A Class XI student was apprehended in the case last month.
