Sabarimala review pleas in top court

Two petitions were filed in the Supreme Court on Monday seeking a review of the September 28 judgment allowing women of all ages to enter the Sabarimala temple.

The petitions have been filed by Nair Service Society and the National Ayyappa Devotees Association.

As and when the apex court decides to hear the petitions, a new judge would have to be nominated to the bench. The original bench was headed by then Chief Justice of India Dipak Misra, who retired on October 2.

Since a review petition is heard by the same bench that gives the original verdict, the other four judges — Justices R.F. Nariman, A.M. Khanwilkar, D.Y. Chandrachud and dissenting judge Justice Indu Malhotra — will have to be necessarily accommodated.

It is the prerogative of Chief Justice Ranjan Gogoi to decide whether to himself head the new bench or nominate some other senior judge.

In its petition, the Nair Society has said the verdict ought to be set aside as the top court proceeds on the erroneous foundation that the practice is derogatory to women.

The petition, filed through advocate K.V. Mohan, said a large section of women worshippers have come out in support of the custom that prohibits the entry of women between the age of 10 and 50 years into Sabarimala temple.

The other petition filed by the National Ayyappa Devotees Association, through advocate Mathew J. Nedumpura, pleaded that the apex court ought to recall its judgment as it “has sent shock waves among millions of Ayyappa devotees”. According to the association, the ruling is in violation of the fundamental right to practise one’s religion.
