Chargesheet filed in 9A trespass case

Police on Wednesday filed the chargesheet related to the November 11 trespass on 9A Short Street, in which an arrested sub-inspector is among the 18 accused.

Two bouncers who were part of the group that had allegedly trespassed on the property were gunned down. Mamta Agarwal, who ran a playschool on the premises, and two guards she had hired are behind bars in connection with the shooting.

“Wednesday’s chargesheet, submitted in Bankshall court, is in connection with the trespass, aimed at evicting the 9A residents. The chargesheet for the murders will be filed in a day or two,” said an officer associated with the 9A probe.

The 800-plus page chargesheet — filed 87 days after the incident — names 18 accused, including realtor Parag Majmudar, his associate Rajesh Damani, real estate agent Pinakesh Dutta, two lawyers and the arrested sub-inspector of Shakespeare Sarani police station, Noor Ali.

All have been charged under IPC sections 120 (criminal conspiracy), 148 (rioting), 458 (lurking house-trespass) and 459 (grievous hurt while committing lurking house-trespass). If convicted, they could be imprisoned for life.

Three accused — the owner of the security agency that had allegedly sent bouncers for the eviction raid and two others — have been mentioned as fugitives.

The chargesheet says Ali, who had investigated an alleged dacoity at 9A on September 15, made a false entry in the general diary book of the police station to give an impression that he had ensured proper security for the property.

“Noor mentioned in the diary book that he had deployed two constables in front of the Short Street premises the night before the raid. After examining the duty roster of Shakespeare Sarani police station and interrogating the two constables, we came to know that the entry was false,” said an officer of the detective department.

“Noor had probed the September dacoity, during which a firearm of a 9A resident was looted. Mamta Agarwal, one of the residents, told Noor several times that she was fearing a second raid. Noor did nothing despite knowing beforehand about the November 11 raid,” said the officer.

The chargesheet has named 103 witnesses. “We have gathered incriminating evidence and statements of the witnesses,” the officer said.

Majmudar, the sleuth said, wanted to evict the residents of the property. “Damani was the bridge between Majmudar and Pinakesh Dutta, who hired the security agency and the bouncers,” the officer added.
