Where?s the cash?

I have had 140 shares of Khaitan Electricals Ltd, Hyderabad, for a very long time. The company has not yet sent me the dividend for the year 2002-03. I have written a number of letters to the top officials of the company. But none of them have acknowledged receipt of my letters. This is indeed very unfortunate. Please suggest some action I can take against the company for harassment. My registered folio number is 11745.

nthe company: With reference to your letter, we would like to inform you that we had sent the dividend to the complainant through ECS to his Global Trust Bank account (no. 1601011798) on October 1, 2003. However, the amount was returned as the account was closed. We are sending the amount through a money order (receipt no. 4895) to the complainant.

nthe expert: From the company response it seems that the matter has already been taken care of. However, if you haven?t yet received the dividend, then please consult a lawyer for further action. It is the duty of any company to fulfil the assurance it gives its clients.

Exchange or refund

I had purchased an oval six-seater dining table (model no. 51B63R) and six chairs (model no. 715XXF) of Rubwood range of furniture from M/s Deb Enterprise Pvt. Ltd, Guwahati, on April 12, 2004. The order was placed verbally by my husband against an advance payment of Rs 2,000. On the day of delivery, a balance of Rs 11,600 was made to the firm.

Very soon, I noticed some flaws in the furniture. One of the six chairs was of a different model and the finishing on all the items was quite poor. We informed the officials about the defects that we?d found.

We followed it up with a number of phone calls and personal visits. We were repeatedly assured of prompt service but nothing has been done so far. I want to exchange the defective pieces of furniture with proper ones or get a refund. Please suggest what I should do now.

There may have been a lapse on our part owing to a change in marketing and customer care staff at the time of the complaint. As a fairly new entrant in the distribution business, we have had to face teething problems, such as the instant case. We hope that we will soon be able to follow up this complaint with a letter of acknowledgement from the complainant.

nthe expert: Let us hope that the issue has been looked into. Judging by the response of the company, that is how it seems. If, however, you find that no action has still come through, then feel free to go ahead and lodge a complaint with the District Consumers Disputes Redressal Commission. Deficient service and the harassment cause by the same are good enough reasons for you to bring the company to the book.

Not much to do

We had jointly purchased five ?Festive Bonds? of Alpic Finance Limited, which amount to Rs 61,000. In addition to this, we had also bought two ?Infrastructure Bond - Series II? from the same company that amount to Rs 11,000. All these bonds have matured quite some time ago. On maturity, we sent the certificates to the company head office in Mumbai. Till date, however, we have neither received the maturity amount nor any letter of explanation from the company authorities. Please suggest a way out of this problem.

nthe company: The Alpic Finance Limited is now under provisional liquidation in case no. 100 of 2002 in company petition no. 853 of 2000. We cannot do anything about the complainant?s grievance. nthe expert: The company letter itself tells you what you should be doing now. You have no relief before the consumer forum now as the company is under liquidation. So, write a letter to the official liquidator and enclose all necessary documents with it. That?s all you can do for the time being.
