The state government has moved an appeal against the order passed by Justice Abhijit Gangopadhyay, of the high court, handing over the probe into the alleged corruption in recruitment of teachers for classes IX and X by the School Service Commission (SSC).
The appeal was first moved before the division bench headed by Justice Harish Tandon but the bench refused to hear it on ‘personal grounds’.
Lawyers appearing for the government then approached Chief Justice Prakash Srivastava.
A high court source said the matter would be referred to the division bench headed by Justice Subrata Talukdar, which has been entrusted by the chief justice to hear appeals related to other appointments by the SSC.
In compliance with an order by Justice Gangopadhyay on Thursday, the CBI filed a preliminary report on its investigation into the teacher recruitment case on Friday.
The CBI told the court that it had served notices on the former chairman of the SSC advisory committee, S.P. Sinha, and other former members of the panel in connection with the probe.
Counsel appearing for the CBI submitted that all five were being questioned by officers of the agency.
Justice Gangopadhyay will take up the matter for hearing again on April 13, when the CBI will have to table a progress report.
