Bombay High Court: IITs must allot vacant seats to students who got the seats but couldn’t pay Round 1 fee

In order to be admitted, two candidates who were given seats in the first round of JEE Advanced counselling but were unable to pay the fees filed an appeal with the Bombay High Court. The High Court took note of their arguments and on Tuesday, October 18, requested that IIT Bombay and IIT Gandhinagar take into consideration admitting them if seats are still available.

The students (petitioners) stated that although they had been given seats in the first round, a technical issue prevented them from paying the fees despite numerous tries. Both students were accepted into IITs; one was at IIT Gandhinagar and the other at IIT Bombay. In the case, according to a LiveLaw report, the two institutes are the respondents.

The issue was heard by a bench of Justices SV Gangapurwala and RN Laddha, who determined that the petitioners are talented students who were given seats in the first round based on their merit. If seats are still available after the sixth and final round of counselling, the Bench instructed the relevant institutes to consider allocating seats to the two students.

The Joint Seat Allocation Authority (JoSAA) was represented by advocate Arjun Mitra, who claimed that the students had been given three days to pay the costs. And when they had a technical issue, they did not get in touch with JoSAA. He further stated that any seats left over after the fifth round would be given to the following deserving applicants in accordance with business rules.

The court noted that the students had not paid the fees with diligence. However, the Bench issued its directive to the IITs since they are deserving students.
