Golaghat, Feb. 17: The Golaghat Bar Association today said its members would abstain from appearing before the court of the subdivisional judicial magistrate, Titabar, till “appropriate action” is taken by Gauhati High Court against the SDJM for detaining one of its members in court lock-up allegedly without following norms.
The decision was taken at a special general body meeting of its members to discuss about one of its member, Jayshree Gogoi Jaiswal, being put in the court lock-up by the court of S.S.A. Rahman, SDJM, Titabar, in Jorhat district on February 15.
The bar association, which has a membership of 350 advocates, will also abstain from all court work tomorrow as a mark of protest against the incident and also move Gauhati High Court through the All Assam Lawyers’ Association for necessary action.
At a news conference held here this afternoon, secretary of the bar association Tridib Bezbaruah said the special general body meeting was of unanimous opinion that the manner in which Jaiswal was detained in court lock-up and produced before the court of the chief judicial magistrate, Jorhat, has tarnished the reputation of the advocate.
The bar association also said the manner in which she was illegally detained by the SDJM on the pretext of committing alleged offence of contempt of court is against established procedure of law and it violates human rights and dignity. The members alleged that such a treatment is an insult to the lawyers’ community.
Bezbaruah said the bar members are feeling insecure to appear before the court of the SDJM, Titabar, and they unanimously resolved to abstain from appearing before the SDJM court till appropriate and desirable action is taken by the high court.
While talking to this correspondent, Bezbaruah said detaining the advocate in court lock-up for several hours in complete advocate’s robe violates procedure established by law and is an infringement on her personal liberty and the act of the SDJM is condemnable in the eye of law.
The bar association has sent a copy of today’s resolution to Gauhati High Court, All Assam Lawyers’ Association and the bar councils of seven northeastern states for taking necessary and appropriate action against the SDJM, Titabar.
A memorandum was also submitted by the bar association to the district and sessions judge at Jorhat for necessary action against the SDJM.
Jaiswal appeared before the court of the SDJM, Titabar, in connection with GR case number 1955/2012. The accused of the case was earlier granted interim bail by Gauhati High Court.
