SC notice on vaccine trials

New Delhi, Nov. 11: The Supreme Court today sought replies from the Centre, Andhra and Gujarat on a PIL seeking regulation on clinical trials being conducted in the two states for HPV (Human Papilomavirus) vaccine.

A bench of Chief Justice P. Sathasivam and Justice Ranjan Gogoi issued the notice on the PIL jointly filed by two NGOs — SAMA, a resource group for women and health and the Karnataka-based Drug Action Forum — and Delhi Science Forum.

But since another bench is already examining the alleged use of gullible patients as guinea pigs by pharmaceutical companies testing various drugs for release, the Chief Justice said the two cases would be tagged and heard jointly.

In the present petition, senior counsel Anand Grover and counsel Lorraine Misquith said PATH, an international NGO working in the health sector, indulged in unethical conduct of clinical trials in collaboration with ICMR between 2009-10 in Andhra Pradesh and Gujarat resulting in violation of the right to health of thousands of young girls, guaranteed under Article 21 (life and liberty) of the Constitution.”
