Q: In 2005, I bought a piece of land from the Bank of India against a newspaper advertisement under the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002. Recently a representative of the State Bank of India took photographs of my land and building in spite of my objection. When I visited the SBI the next day I was told that they have sanctioned a loan against the same land and put out another advertisement in the newspaper in 2012 under the same act. What steps should I take to protect my interest? I am a senior citizen. Can I claim compensation for this harassment?

A: If you do not owe the SBI any money or have no housing loan pending with the bank against the property, then such an act would amount to undue harassment and negligence. You may serve the concerned bank a legal notice and intimate the facts in writing to the local police station. You may thereafter claim compensation from the bank for mental agony by filing a case before the civil court or the consumer forum.
Q:My fatherís will was found after the demise of both my parents. We are four sisters. In the will my father has mentioned two probators who have since died. What should we do now?

A: If the executors of the will have expired, the beneficiaries may file an application under the Indian Succession Act, 1925, before the district delegateís court and apply for letters of administration.
Q:I bought a flat in a building in 2008. The promoter had given me and the other buyers the possession letters. Subsequently, we got our flats registered. But we cannot get the mutation done as the promoter has not got the completion certificate from the municipality as yet. We have asked him many times but to no avail. How can we get the mutation done?

A: The completion certificate of a building is generally issued only when there is no deviation from its sanctioned plan. The mutation cannot be done in the absence of the certificate. Find out the reason for delay from the promoter and also ask him for the details and relevant papers, including applications made to the municipal corporation in this regard. Then follow it up with the KMC.
