Chargesheet against thugs

Guwahati, Sept. 6: The Assam CID has chargesheeted three persons accused of assaulting Public Accounts Committee (PAC) member and BJP legislator Prashanta Phukan in Nagaon on May 29.

Additional advocate general Devajit Saikia today informed Gauhati High Court that the CID had filed the chargesheet against the three accused persons at the court of chief judicial magistrate, Nagaon, on Tuesday.

Vice-chairman of Nagaon zila parishad — Md Nurul Huda and zila parishad members Manik Ali and Md Saiful Islam — allegedly attacked Prasanta Phukan at Nagaon circuit house on May 29. All of them are members of the Congress.

The incident happened when the PAC committee, headed by AIUDF MLA Sirajuddin Ajmal, was visiting Nagaon to review the implementation of government schemes on the Speaker’s instructions.

On June 20, Gauhati High Court had ordered a CID probe into the case after expressing its dissatisfaction at the manner in which Nagaon police were conducting the probe and directed the state government to hand over the investigation to the CID. The high court passed the order after perusal of the case diary and a letter from the CJM, Nagaon.

The CJM in his letter said: “The case is not being properly investigated by Nagaon police as they seem to be protecting the perpetrators of the alleged crime, which is an attack on one of the three pillars of democracy in India, the legislature.”

“The police here do not have the power to arrest even lower-level members of the ruling party like the accused in this case. Hence, I think the case should be investigated by the CBI,” the report said.

The high court had registered a suo motu criminal reference case on basis of the Nagaon CJM’s letter.

Justice B.D. Agarwal today said the state government might take action against the investigating officer who was initially handling the case.

All the three accused are currently out on bail.
