The Todis and three police officers accused in the Rizwanur Rahman case on Tuesday moved separate appeals against the August 14 judgment by Justice Dipankar Dutta of the high court.
The judge had allowed the Central Bureau of Investigation (CBI) to file chargesheets and start criminal proceedings against seven people, including the Todis and the three police officers, for allegedly abetting Rizwanur’s suicide.
On Tuesday, Rizwanur’s family members also moved an appeal against the verdict for not allowing the CBI to file chargesheets and start criminal proceedings against former city police commissioner Prasun Mukherjee and former deputy commissioner (headquarters) Gyanwant Singh, who were initially accused in the case.
Rizwanur’s father-in-law Ashok Todi, his relative Anil Saraogi and the accused officers sought an interim stay on Justice Dutta’s order till the disposal of the case before the division bench.
The appeals were published on Tuesday’s list. The division bench of Justice S.S. Nijjar and Justice Maharaja Sinha decided to hear the matter on Wednesday.
Rahmans’ lawyer Kalyan Banerjee said all the appeals would be heard jointly by the bench.
According to high court sources, the state government will also move an appeal against Justice’s Dutta’s order.
In their appeals, Ashok Todi and Anil Saraogi have challenged the authority of the high court to ask the CBI to file chargesheets against them on the basis of preliminary findings of an inquiry conducted by the agency.
The appellants claimed Justice Dutta had formed his opinion and made adverse observations about them on the basis of unconfirmed findings of the CBI.
Details of the appeals by the officers — former deputy commissioner (detective department) Ajoy Kumar, assistant commissioner (anti-rowdy section) Sukanti Chakraborty and the sub-inspector of the anti-rowdy section of Lalbazar, Krishnendu Das — were not available till late on Tuesday.
