The registration of a flat I bought in Utsa, the condoville of Bengal Ambuja, is yet to be done though the flat was handed over in September 2004. We have deposited all necessary papers as and when requested by the developer, who is responsible for the registration.

We were told that we would have to be members of the cooperative society before the registration can be done. We submitted all the papers required for the membership.

The cooperative society secretary said our names, along with 17 others, had been forwarded to the Deputy Registrar of Co-operative Societies, Salt Lake, for membership and gave us a photocopy of the document. When we showed it to Bengal Ambuja for registration, we were told there was some conflict in the society and the company could not do anything. We have to get the registration done as the bank, where we took loan from, is piling pressure on us.

Bengal Ambuja replies to The Telegraph:

1) According to the agreed terms, the allottees were required to form the cooperative housing society and take over the charge of maintenance and management of the common areas and facilities of the complex.

2) Bengal Ambuja voluntarily undertook to act as facilitator and helped the allottees complete the formalities for registration of the society. About 60 per cent of the allottees of the apartments have already become its members.

3) Since the allottee concerned did not take steps to become a member of the cooperative society when it was being registered, he could not be part of it initially.

4) Registration of deeds of transfer of more than 90 per cent of the allottees who have become members of the society has already been completed.

5) To become a member of the society after its registration, the allottee concerned will have to approach the elected body of the society and Bengal Ambuja cannot have anything to do in this regard.

6) We understand that for the last few months, there has been a dispute among the society office-bearers.

7) Because of this, papers and documents submitted by the allottees, who have not yet become members, are lying pending at the cooperative office, which is beyond the control of Bengal Ambuja.

8) Bengal Ambuja is not in a position to register the deeds of transfer in favour of the allottees as the signatories of the cooperative society have not yet been able to resolve the dispute.

9) The allottees have been advised to refer the matter to the registrar concerned requesting his intervention for resolving the dispute at the earliest so that Bengal Ambuja can take steps for registration of the deeds of transfer.
