Ranchi, April 5: Jharkhand High Court directed the police to proceed in the investigation of a particular case after the CID has submitted its chargesheet.
While hearing a criminal writ, the court directed the police not to take coercive steps as the matter is under the supervision of the CID.
The petitioner Rakesh Yadav had filed the case informing the court that the police are investigating a case, in which he is alleged to be one of the accused.
Yadav said the police having failed to conduct the inquiry had prompted the home department deputy secretary to hand over the case to the CID.
The case relates to an incident in October 2004 when one Sanjay Kumar Singh of Paramatu village in Chatra had lodged an FIR against Yadav and other persons for looting and plundering his home.
Singh had allegedly identified the petitioner to be also one of the extremists, who were led by their area commander Santosh Yadav.
The matter was at first investigated by the police which proved to be unsatisfactory and was then handed over to the CID. However, despite CID investigation, the police continued with their inquiry and attached the property of the petitioner.
Being aggrieved, the petitioner moved the court and questioned the authority of the police in taking up the case when it has been handed over to the CID.
