Court rules on employee FIR

NEW DELHI (Reuters): Observing that non-disclosure of a criminal case registered by police after a person applies for a government job cannot be considered “wilful suppression” or “concealment” of facts, Delhi High Court has directed Delhi police to take a dismissed constable back into service.

A division bench of Justices Manmohan Sarin and Vipin Sanghi set aside an order passed by Delhi police and the Central Administrative Tribunal, which dismissed the plea of constable Nirbhai Singh for his reinstatement into service after he was charged with abetting his sister-in-law’s suicide.

The judges said a provision seeking a declaration of quitting the job following a criminal case registered in the future was missing in the application form for the post.
